PUBLIC WEBSITE TERMS OF USE, PRIVACY NOTICE & CONDITIONS

1. Scope, Parties, and Affirmative Acceptance

These Public Website Terms of Use, Privacy Notice & Conditions (“Terms”) are issued by Thankful Pumpkins (“FBO”) and govern the public-facing interaction between FBO and each living man or woman who views, accesses, communicates through, submits information through, registers through, provides checkout information through, or otherwise interacts with the public website or a related public-facing platform.

For purposes of these Terms, “Visitor” means the living man or woman interacting with FBO who has not yet been accepted as a Member through the Private Member Agreement “PMA”.

Before providing an email address, submitting an inquiry, registering for an event or Offering, creating an account, providing checkout information, entering a restricted area, or requesting access to a webinar, workshop, class, consultation, or other interaction, Visitor is provided access to these Terms and the Private Confidential Disclosure Agreement “PCDA” and shall affirmatively accept both through the required electronic checkbox or another clearly disclosed acceptance method.

By affirmatively accepting these Terms and the PCDA, Visitor confirms that Visitor:

a. is a living man or woman at least eighteen (18) years of age and of sound conscious mind;

b. acts voluntarily and in private capacity for the interaction;

c. was provided an opportunity to read both documents before acceptance;

d. accepts the confidentiality, Property, privacy, conduct, capacity, electronic-interaction provisions stated therein;

e. agrees that the electronic act (such as checking a box), date, time, version, and related transaction information may be preserved as a Record of acceptance; and

f. comprehends that acceptance of these Terms and the PCDA alone does not create Member status.

Member status begins once Visitor accepts the PMA and FBO accepts Visitor into the private Member relation. Members-only access is governed by the PMA and the applicable Offering Terms.

2. Public Definitions and Relation to Private Documents

“Artificial Intelligence” means a nonliving artificial-intelligence, machine-learning, generative, predictive, automated, biometric, surveillance, language-model, algorithmic, robotic, or similar system, tool, model, platform, or agent.

“Confidential Information” means nonpublic information disclosed, exchanged, observed, accessed, recorded, or learned through an interaction with FBO, including identity, communications, methods, Records, Property, Member information, business information, spiritual or ministerial information, and information designated or reasonably understood as private.

“Contribution” means the value voluntarily provided for an accepted Offering, Product, access, or other stated exchange and may include money, lawful money, goods, services, or another agreed form of value.

“External Entity” means an outside organization, office, platform, provider, agency, Artificial Intelligence system, or other non-Member third party acting outside the FBO relation.

“FBO Property” or “Property” means the website, text, images, audio, video, recordings, calls, events, courses, templates, documents, methods, systems, marks, logos, communications, community content, Products, Records, downloads, platforms, and all other material owned by, created for, licensed to, or entrusted to FBO.

“Harm” means actual or credibly threatened injury, loss, exploitation, destruction, abuse, unauthorized disclosure, misuse of Property, or serious interference with the rights, safety, dignity, Property, or peaceful participation of another. Mere disagreement or good-faith inquiry does not by itself constitute Harm.

“Material Breach” means a serious act or omission that substantially defeats the purpose of these Terms, the ``PCDA, or another applicable agreement, misuses authority or access, or causes significant Harm, such as unauthorized copying, disclosure, use or sale of Property, fraud, exploitation, intentional misuse of Confidential Information, or refusal to stop or correct a continuing breach after proper Notice.

“Offering Terms” means the Written terms attached to a particular Offering, such as the Contribution, access period, schedule, delivery, cancellation, pause, credit, refund, Product, Service, or other Offering-specific conditions.

“Offering” means an event, webinar, workshop, class, course, consultation, community, service, Product, program, access arrangement, or other stated opportunity made available by FBO.

“Pre-Existing Property” means writings, recordings, names, marks, methods, systems, materials, knowledge, content, or other Property owned or controlled by a Visitor, Member, FBO, or another Party before being submitted, disclosed, or used in connection with the interaction. Pre-Existing Property remains with its existing owner unless a separate Written transfer or license states otherwise.

“PCDA” means the separate Private Confidential Disclosure Agreement accepted with these Terms and continuing for all protected disclosures and interactions.

“PMA” means the Private Member Agreement provided through the authorized Member-entry process and accepted before Member status and Members-only access begin.

“Record” means information preserved in Written, electronic, audio, video, platform, transaction, access-log, email, or other reproducible form.

“Restoration” means the process of correcting a breach or Harm, such as stopping the conduct, correcting the Record, returning or removing Property, providing an accounting when applicable, making agreed restitution, correcting false information, or completing another reasonable restorative action under the applicable agreement.

“Written” or “Writing” contains a paper or electronic Record capable of being retained and reproduced.

These Terms independently govern the public-facing matters stated herein. The PCDA independently governs Confidential Information for all interactions.

3. Capacity; Outside Titles, Oaths, and Agencies

All Visitors who accept these Terms and/ or the PCDA enter the interaction solely as a living man or woman in private capacity. Any public, professional, corporate, governmental, licensed, fiduciary, military, BAR, agency, office, oath, commission, credential, or title held outside FBO is suspended and disclaimed for every purpose arising from the interaction and shall not be invoked to govern, represent, investigate, report upon, bind, or interfere with FBO, its Members, Property, Records, communications, or private relations.

Any attorney, officer, agent, licensed professional, or other title-holder enters only as a living man or woman and not as an agent or representative of an outside principal, office, court, association, agency, or External Entity unless FBO gives prior express Written authorization. This provision governs capacity and authority within the interaction and does not purport to cancel an outside obligation that cannot be waived by private agreement.

4. Public Access, Registration, and Member-Entry Process

Public pages may be viewed only for their stated purpose. Acceptance of these Terms and the PCDA permits Visitor to proceed to the requested email, inquiry, registration, checkout, or Member-entry step; it does not grant Member status or Members-only access.

1.   Visitor accepts these Terms and the PCDA through the required public checkbox or other disclosed affirmative act.

2.   Visitor provides the requested email, inquiry, registration, or other contact information.

3.   FBO may review the interaction, invitation, and provide the PMA.

4.   FBO accepts Visitor into the private Member relation and then releases the authorized Members-only access.

FBO may decline, pause, or discontinue an inquiry or Member-entry process when the interaction is incomplete, inconsistent with FBO Mission, presents a security or safety concern, or does not meet the stated Offering requirements.

5. Ownership, No Copying, and Authorized Use of Property

All Property shared or made available by FBO remains the exclusive, proprietary, spiritual Property of FBO or the identified contributing owner. Public access or authorized Member access grants only a limited, personal, revocable, non-transferable right to view and use the Property for the expressly stated purpose. No ownership, publication, teaching, distribution, resale, licensing, commercial, database, training, or derivative-work right is granted.

No Visitor or Member may copy, reproduce, record, capture in bulk, scrape, crawl, mirror, archive, download beyond the permitted use, modify, adapt, translate, summarize for distribution, share, teach, publish, transmit, distribute, resell, repurpose, license, transfer, disclose, train Artificial Intelligence upon, upload into Artificial Intelligence, or commercially use any Property, in whole or in part, without prior express Written authorization from FBO.

No Visitor or Member may provide a login, private link, document, recording, transcript, screenshot, template, communication, Member information, or other Property to another man or woman, an Entity, a platform, an agency, or Artificial Intelligence without prior express Written authorization.

Any and all-knowing unauthorized access, use, disclosure, copying, training, or transfer constitutes intentional trespass, Material Breach, misappropriation, wrongful taking, and deliberate Harm and Loss. FBO may revoke access, preserve the Record, require return or destruction of Property, request correction, restitution, and Restoration, and pursue the remedy process stated in the agreement applicable to the interaction.

6. PCDA; Confidentiality for Every Interaction

The PCDA applies to Confidential Information disclosed through every inquiry, email, form, registration, conversation, consultation, review, collaboration, event, Offering, service, Member relation, community, payment, support request, or other interaction with FBO. It begins upon Visitor’s acceptance and continues before, during, and after Member entry, withdrawal, completion, termination, or the end of an Offering.

These Terms do not replace or reduce the PCDA. When the PCDA provides a more specific confidentiality, nonuse, nondisclosure, Notice, return, destruction, survival, or remedy provision for a protected disclosure, that provision governs the confidentiality matter.

7. Accounts, Links, Passwords, and Security

When an account, access link, password, code, or private platform is provided, Visitor or Member agrees to provide accurate current information, protect all credentials and links, use them only for the authorized relation, and promptly notify FBO of suspected unauthorized access or security concerns.

·     Do not use another living man’s or woman’s account, credentials, payment information, access link, or identity.

·     Do not share an account, recording, private link, meeting link, password, code, or download with another.

·     Do not attempt to bypass access controls, platform restrictions, security tools, or Member-entry requirements.

·     FBO may require identity confirmation, updated acceptance, a new password, or another reasonable security step before restoring access.

8. Community Conduct and Submitted Content

Public comments, forms, community areas, groups, forums, chats, calls, and similar tools must be used in honor, truth, peace, privacy, and do no harm. FBO may remove content or restrict access when reasonably necessary to protect Members, Property, Confidential Information, platform integrity, safety, or FBO Purpose.

·     Do not post or transmit threats, harassment, abuse, exploitation, defamation, obscenity, malicious code, spam, impersonation, knowingly false information, or another’s Confidential Information or Property.

·     Do not collect, mine, export, sell, profile, monitor, or use Member or Visitor information without prior express Written authorization from the affected living man or woman and FBO.

·     Do not represent a personal statement as an official FBO statement without Written authority.

·     Do not upload content that Visitor does not own or have authority to provide.

·     Information voluntarily posted in an area clearly identified as public may be viewed by others and should not contain private or sensitive information.

Visitor retains ownership of Visitor’s Pre-Existing Property submitted to FBO. By submitting content through an authorized feature, Visitor grants FBO only the limited, non-exclusive right reasonably necessary to receive, host, display, preserve, moderate, respond to, and administer that content for the stated interaction.

9. Privacy Notice — Information Collected

FBO may collect information reasonably connected to the public interaction, Member-entry process, Offering, order, communication, or security need, including:

·     contact information, such as living name, email address, telephone number, mailing address, and shipping address;

·     inquiry, registration, intake, application, event, scheduling, and Member-entry information;

·     Contribution, checkout, transaction, payment-plan, refund, credit, and shipping information received from payment or fulfillment providers;

·     communications, PCDA and Terms acceptance Records, support requests, surveys, feedback, and content voluntarily submitted;

·     device, browser, IP address, general location, cookie, analytics, referral, and website-interaction information;

·     security, consent, access, version, date, time, and Record information reasonably needed to protect FBO, Visitors, Members, and Property.

10. Privacy Notice — How Information Is Used

FBO may use collected information to:

·     provide the requested page, form, communication, inquiry response, registration, checkout, or Member-entry step;

·     provide and administer the PCDA, PMA, Offering Terms, accounts, access, Member Engagement Levels, scheduling, and support;

·     process Contributions, orders, credits, refunds, shipping, and payment-plan administration;

·     send requested communications, access links, scheduling notices, transaction notices, security Notices, and Member information;

·     protect security, prevent misuse, investigate unauthorized access, preserve Records, and apply the applicable agreement process;

·     improve website function, communications, offerings, and Member experience;

·     meet a clearly applicable recordkeeping, safety, fraud-prevention, payment, shipping, or outside-service requirement.

FBO does not sell personal information. FBO may provide limited information to contracted providers only as reasonably necessary to operate the website, preserve acceptance Records, process Contributions, send communications, host platforms, provide analytics, fulfill orders, or protect security. Each outside provider remains governed by its own terms and privacy practices.

11. Notice at Collection and Privacy Choices

Before or at the point information is collected, FBO shall identify the general purpose of the form, registration, checkout, cookie, or other collection method. Visitor may choose not to submit optional information, but FBO may be unable to complete the requested interaction without information reasonably necessary for that purpose.

A living man or woman may send Written Notice requesting correction of inaccurate contact information, closure of an unused public account, withdrawal from optional marketing communications, or information about FBO’s current privacy practices. FBO may request reasonable identity confirmation and may retain Records necessary for active agreements, Contributions, security, Property protection, dispute prevention, internal process, financial administration, or another continuing duty.

12. Cookies, Analytics, and Optional Marketing Communications

The website may use cookies, pixels, analytics, embedded tools, or similar technologies to remember settings, maintain forms or accounts, support checkout, preserve acceptance, understand website use, improve function, and protect security. Visitor may adjust browser settings or available cookie controls; disabling certain tools may limit registration, account, checkout, or restricted-access functions.

FBO may send transactional, acceptance, access, scheduling, account, Contribution, security, and Member-entry communications reasonably necessary for the requested interaction. Optional promotional email, text, or other marketing communication requires a separate choice and may be discontinued through the stated unsubscribe or Notice process. Ending optional marketing communication does not stop necessary transaction, security, offering, or agreement Notices.

13. Data Security and Electronic Communication

FBO uses reasonable administrative, technical, and access safeguards appropriate to the information and services used. FBO does not promise that internet transmission, email, cloud storage, third-party platforms, payment processing, or any digital system will be uninterrupted, error-free, or completely secure.

Visitor accepts the inherent risks of electronic communication and agrees not to send highly sensitive information through an unapproved channel. Visitor shall promptly notify FBO of suspected unauthorized access, impersonation, credential compromise, mistaken disclosure, or other security concern.

14. Age Requirement and Children’s Information

The public website, forms, Member-entry process, and Offerings are intended for living men and women at least eighteen (18) years of age. FBO does not knowingly invite a offspring (child) to provide independent acceptance, an email address, a Contribution, or Member-entry information through the adult process.

15. Third-Party Platforms, Links, and Providers

FBO may use or link to payment processors, scheduling tools, email providers, video platforms, social platforms, form providers, analytics providers, fulfillment services, shipping carriers, or other outside services. A link or technical connection does not create endorsement, ownership, control, or responsibility for the outside provider’s content, availability, security, terms, conduct, or privacy practices. Use of an outside service is also subject to that provider’s terms.

16. Contributions, Checkout, Cancellation, and Refunds

When Visitor proceeds to a Contribution or checkout step, the applicable Product or Offering page shall state the Contribution amount and any access, cancellation, pause, credit, and refund terms.

All Contributions are non-refundable after digital access, performance, preparation, shipment, or other delivery begins unless the checkout or Offering Terms expressly state otherwise or FBO approves a Written exception. Recurring Contributions continue until ended according to the stated Offering Terms and Notice process. Failure of a scheduled Contribution may pause or suspend access.

Visitor or Member agrees to first send Written Notice and allow a reasonable opportunity for clarification before initiating a payment dispute for an authorized transaction. This does not prevent a good-faith report of fraud or an unauthorized transaction.

17. Physical Products, Shipping, and Delivery

When FBO offers a physical Product, the Product description, Contribution, shipping method, estimated processing time, tracking option, destination limits, customs responsibility, return conditions, and replacement terms shall be stated at checkout or in the applicable Offering Terms.

·     Delivery estimates are not guarantees and may be affected by carriers, customs, weather, holidays, supply limits, or events beyond FBO’s reasonable control.

·     The recipient is responsible for accurate delivery information, destination charges, customs duties, taxes, and import restrictions unless checkout states otherwise.

·     FBO is not responsible for loss or theft after documented carrier delivery. A claim for loss or damage before delivery must be reported within seven (7) days with available photographs, tracking, and packaging information.

·     Backordered or unavailable Products may be replaced, credited, refunded, or cancelled as stated in the specific order communication.

18. Educational Purpose, Discernment, and No Guarantee

Public content and FBO Property are offered for the educational, informational, spiritual, ministerial, community, wellness, and entertainment purposes stated for the page or Offering. No public content is a promise or guarantee of a legal, tax, medical, financial, business, spiritual, health, or personal outcome. Visitor remains responsible for personal discernment, questions, decisions, actions, implementation, and selection of outside support.

19. Website Availability and Changes

The website, forms, platforms, downloads, accounts, communications, and Property are provided as available. FBO may maintain, correct, update, relocate, suspend, or discontinue a page, platform, feature, form, or access method. FBO does not guarantee continuous availability, compatibility with every device, absence of errors, or protection from every virus, outage, interception, platform change, or third-party failure.

20. Suspension, Refusal, and Termination of Access

FBO may refuse, restrict, suspend, or terminate public or restricted access when reasonably necessary to address unauthorized access, nonpayment, security risk, harassment, threats, exploitation, false information, infringement, copying, disclosure, misuse of Property, breach of the PCDA, violation of Community Guidelines, or another Material Breach.

When appropriate, FBO may provide Notice and an opportunity to respond or cure. Immediate action may be taken when delay could expose FBO, a Visitor, a Member, Property, Confidential Information, or a platform to continuing Harm.

Termination ends future access but does not erase duties that by their nature continue, as well as PCDA confidentiality, Property restrictions, unpaid obligations already accepted, return or destruction of Property, preservation of Records, restitution, internal process, and remedy.

21. Notice of Property, Privacy, or Account Concern

A living man or woman asserting a good-faith concern regarding Property, privacy, account access, submitted content, an acceptance Record, or an electronic interaction shall send Written Notice identifying the sender, the specific Property or information, the factual basis of the concern, the requested action, and supporting evidence. FBO may request identity or authority confirmation before disclosing, removing, changing, or restoring access.

Notice shall be sent as provided above:

22. Material Breach, Unauthorized Copying, Commercial Use, and Remedy

Visitor and Member acknowledge that all FBO Property is private, proprietary, valuable, and provided only through a limited, revocable, non-transferable authorization for the stated purpose. Any unauthorized copying, recording, adaptation, teaching, sharing, disclosure, publication, distribution, resale, commercial use, Artificial Intelligence training, account access, data harvesting, removal of ownership notices, or misuse of Confidential Information constitutes intentional trespass and Material Breach.

Upon evidence of breach, FBO shall immediately terminate access; require all use, sales, teaching, advertising, and distribution to cease; demand removal, return, or verified destruction of the Property; and require a Written accounting of all copies, recipients, sales, Contributions, revenue, and profits.

FBO may pursue takedown procedures, injunctive relief, restitution, actual damages, attributable profits, lost licensing value, reasonable enforcement costs where permitted, and all remedies available under the applicable agreement. When the breaching Party has accepted the PMA, the PMA Default Remedy also applies.

Each unauthorized sale, disclosure, publication, transfer, or commercial use shall constitute a separate Material Breach. FBO may select an authorized forum permitted by the applicable agreement and enforceable jurisdictional requirements.

23. Changes to These Public Terms

FBO may revise these public Terms by posting the updated version with a new Effective Date. Updated Terms govern future public interaction after conspicuous Notice and renewed acceptance when required. A revision does not silently change a PMA, accepted Offering Terms, or a completed transaction.

24. International Access

Visitor accessing the website or Property from another country or region does so by personal choice and remains responsible for determining whether access, receipt, payment, shipment, or use is permitted in that location. FBO does not represent that every page, Product, Offering, payment method, or shipment is available in every location.

25. Entire Public Agreement, No Waiver, Assignment, and Severability

For the public-facing matters addressed herein, these Terms and the accepted PCDA form the complete public first-layer agreement. After Member entry, the PMA and applicable other agreements separately govern the private Member relation and selected Offering(s). No public Visitor may assign or transfer access, rights, acceptance, or duties without prior express Written authorization from FBO.

A failure to enforce one provision is not a continuing waiver. If a provision is determined to be invalid or unenforceable for a particular matter, the remaining provisions continue to the fullest extent possible, and the original purpose shall be preserved through a valid provision consistent with the accepted agreements.

By the required checkbox or other clearly disclosed affirmative act, Visitor/Member confirms and agrees that these Terms and the PCDA were available before acceptance, that Visitor had an opportunity to read them and submit questions, and that Visitor/Member voluntarily accepts before providing contact information or proceeding with the requested public interaction.
